Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the PairQuiz mobile application (the "App") operated by BarberRiley.com ("us", "we", or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App. By accessing or using the App you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
1. Intellectual Property
The App and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of BarberRiley.com and its licensors. The App is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BarberRiley.com.
2. User Data and Local Storage
PairQuiz operates as a "local-first" application. This means:
- All data you enter (names, quiz answers, game progress) is stored directly on your device.
- We do not store a copy of your data on our servers.
- If you delete the App from your device, your data will be permanently lost and cannot be recovered by us.
- You are solely responsible for backing up your device to prevent data loss.
3. Subscriptions and In-App Purchases
The App may offer premium features that can be unlocked via a subscription or a one-time purchase ("Pro" features).
Payment Processing
All payments are processed through the Apple App Store or Google Play Store. We do not collect or store your payment card details.
Subscriptions
If you purchase a recurring subscription, it will automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions in your device's Account Settings.
Refunds
Refund requests must be made directly to the store where you purchased the App (Apple or Google), as we do not have the ability to process refunds directly.
4. Third-Party Services and Links
Our App may contain links to third-party web sites or services (via Advertisements served by AdMob) that are not owned or controlled by BarberRiley.com. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party web sites or services. You acknowledge and agree that BarberRiley.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such web sites or services.
5. Limitation of Liability
In no event shall BarberRiley.com, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the App;
- Any conduct or content of any third party on the App;
- Any content obtained from the App; and
- Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
6. Disclaimer
Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
BarberRiley.com does not warrant that:
- The App will function uninterrupted, secure, or available at any particular time or location;
- Any errors or defects will be corrected; or
- The App is free of viruses or other harmful components.
7. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
